Oakland, CA McDonald’s Workers Sue Management Over COVID-19 Outbreak

Workers at a McDonald’s in Oakland, CA have filed a lawsuit against restaurant management alleging that the working conditions there created a situation where there was a COVID-19 outbreak. Ben: Joe, how you doing?

Joe: I am doing well. So I got a question for you. I was just reading about this lawsuit against McDonald’s in regards to COVID-19. What can you tell us about this?

Ben: Well, what I can tell you is that there have been a number of employees that worked at a particular McDonald’s location out in Oakland, California, who are alleging that the working conditions at that particular McDonald’s created a situation where there was a COVID outbreak. Twenty-five cases were reported stemming from that particular McDonald’s. It’s unclear if there were 25 employees that got sick or if there were 10 employees and then a couple of customers. I’m not really sure.

Joe: Yeah, I was gonna say, how did they figure that number?

Ben: I guess that that will be part of the proof that will be set forth by the plaintiff’s attorney. But essentially, it seems like they’ve been able to make at least a prima facie case to say, “Here’s this set of employees, they were working under these conditions at McDonald’s, and McDonald’s failed to provide personal protective equipment. And as a result of that, or a result of the working conditions, McDonald’s has allowed for these people to be exposed to COVID-19 in an irresponsible, negligent way.” It’ll be interesting to see what happens with this particular case. I think that it’s one of, probably, a string of cases that we will see heading into the future here with this type of litigation.

Joe: Let’s say one of the plaintiffs in this case actually died from COVID-19. Do they then add wrongful death to that lawsuit?

Ben: I would think so. Yes.
