While the benefits of No-Fault coverage are very helpful if you have been unable to work, or have any medical expenses as a result of the accident, it does not award money for pain and suffering.  In New York State, one must experience a “serious injury” in order to collect for pain and suffering. The insurance law defines a “serious injury” as:

  • Permanent loss of use of a body, organ, member, function, or system
  • An impairment/injury of a non-permanent nature that prevents the victim from conducting his or her usual and customary daily activities for a period of at least 90 days during the 180 days immediately following the accident
