Railroad / FELA Claims

Many people are aware of the existence of Workers’ Compensation laws, but did you know that there is a similar law pertaining solely to railroad workers? It’s called the Federal Employers’ Liability Act(FELA) and was passed by Congress in 1908 to allow railroad workers to sue their employers for injuries suffered while on the job.

While it is similar to Workers’ Compensation laws, it differs in that the injured railroader is required under FELA to prove that his employer was “legally negligent” and that the negligence resulted in the injury. If the negligence is legally proven, the railroader is entitled to full compensation, including payment for lost wages, medical expenses, and even coverage for pain and suffering. It is possible that a railroader’s compensation under FELA may be greater than a non-railroader’s compensation under New York State Workers’ Compensation laws for similar injuries. 

It should be noted that FELA is applicable only to common carrier railroads, not all railroads. A common carrier can be defined as one who engages in the business of transportation of persons or property from place to place for compensation, offering his services to the public generally. One who seeks to recover damages under the Federal Employers’ Liability Act (FELA) must first establish these four elements:

  • The railroad is a common carrier engaged in interstate commerce
  • The injured party was employed by the railroad and assigned to perform duties which furthered the railroad’s interest
  • Demonstrate that harm was sustained while he/she was employed by the common carrier
  • Prove that the harm experienced was a result from the railroad’s negligence – a legal term for failure to take a reasonable amount of care

The railroad’s negligence also includes the negligence of all other railroad employees, but only if the bad decisions were made as part of their jobs. Any careless decision could be considered negligent, including:

  • Failure to provide safety equipment
  • Bad decisions or inattention by other railroad employees
  • Poor maintenance of trains, rails or other equipment
  • Failure to prevent chronic repetitive stress injuries
