Nursing Home Negligence and Abuse Law Firm

As loved ones get older, it may become increasingly difficult to secure the care needed to keep them healthy and safe at home, especially if they are living alone. Often times, this is why many families across the world choose to enroll their elderly loved ones in a nursing home; to ensure they get the guidance and safety needed to maintain a healthy lifestyle.

However, what happens if these nursing homes or long-term care facilities are not working up to their standards? What if you find out that your loved one is, in fact, at greater risk since moving into this facility? The sad and awful truth is that, in some cases, this does happen. Patients of long-term care facilities and nursing homes sometimes face abuse and neglect from staff members. It is important to understand that if your loved one has suffered from abuse or neglect from someone at the nursing home, you can take action on behalf of your family member. The nursing home negligence lawyers at Martin, Harding & Mazzotti, LLP® can help you.

Wrongful Death

Dealing with death is never an easy thing. If you are involved with a loved one’s wrongful death case, be sure you understand what is needed in order to get the full inheritance to those who will be awarded it. In regards to claiming a wrongful death case, the Administrator or Executor of the specified Estate may file a claim if someone has been injured as a result of negligence, and later dies with this injury as the cause.

New York State law permits a recovery for any economic loss that is a result of a wrongful death. Also taken into account is a recovery for conscious pain and suffering experienced from the deceased. Since the jury requires an understanding of just how much economic loss the Estate can fairly claim, when determining a specific dollar amount several different variables are taken into account:

  • Character, habits and ability of the deceased
  • Services the deceased would have performed
  • Portion of the deceased’s earnings that would have been spent to care for and support the family
  • The intellectual, moral and physical training guidance and assistance of the deceased that would have been passed down to future generations

This is a difficult process but contains a very important mix of information that will all work together to determine just how much money will be given to those who will inherit.
