I’m attorney Paul Harding with the law firm Martin, Harding and Mazzotti – the Heavy Hitters – here in Saratoga Springs, New York. Everyday across the country almost one hundred thousand people are injured. Many of these injuries are severe enough to result in hospitalization or even death.
The unfortunate truth is that a number of these cases are caused by someone else’s negligence. The consequence of this negligence may be a personal injury case.
But what exactly is a personal injury case?
Personal injury cases can include – automobile wrecks, dog bites, defective products, medical malpractice, premises liability and many other case types.
If someone else’s negligence has caused you harm, you have the right to seek compensation, a right that should not be ignored.

Dog Bite Injuries
We know that it is not in every dog’s nature to be ferocious and aggressive, but mixed with the right company and elements, even a nice dog can cause harm to someone. If an owner has knowledge of their dog or household pet attacking in the past, precautions must be taken to ensure that their pet will not cause harm in the future. In order to file an injury claim against an owner of a dog or household pet that has attacked someone, they must prove that the owner either had knowledge of or should have had knowledge of the animal’s “vicious propensity.”
Vicious propensity covers the following:
- Aggressive barking
- In some instances, the act of restraining the pet
- The pet is a ‘guard dog’
Important information that our lawyers would look for is whether the dog has bitten, chased or attacked in the past, if the owner has had to use a muzzle on the dog or keep it locked up around company. If the dog has been seen snarling or snapping at people, this too may be able to help us learn more about the pet’s past behavior, which will aid in issuing a claim if an unfortunate attack occurs. Simply the breed and size cannot determine the viciousness of the dog. For this reason, it is important to get as much information possible of prior signs of aggression.

When playing a sport, especially a contact sport, risks are assumed, and injuries may be unavoidable. However, was the injury a result of a breach in someone’s duty to provide a reasonable level of care? If so, call our dedicated sports injury attorneys and find out if you’re entitled to file a claim.
Although sports injuries are not often thought of as a major risk for adults, greater than 1.9 million people between age 25 and age 40 were seen in emergency care centers in 2012. Serious injuries are often very costly, but minor injuries such as a sprain can cost an average of anywhere between $2,294 and $7,666.
Injuries to Children and Teens
As you would expect, children and teens experience the most sports injuries, but this is mostly because they have the largest number of participants in organized sports. 30 million children and teens up to age 14 play, and 3.5 million are injured each year. Football causes the most serious injuries, but basketball, unexpectedly, causes the greatest number of injuries to kids. If your child is hurt due to negligence of the coaching staff, you could have a winnable lawsuit on your hands.
A lawsuit was settled for $8 million in the case of Blake Hunt, a football player in NY. The Department of Education, the Public Schools Athletic League, and the Parks Department were found liable due to improper training, a lack of supervision from coaches, and being unprepared for the scrimmage in which the injury occurred. Tragically, Blake Hunt was paralyzed from the waist down.
