There have been thousands of lawsuits filed across the United States claiming that the manufacturers of testosterone products have put healthy men at risk for cardiac arrest and/or blood clots. Many of these lawsuits implicate AbbVie, the manufacturer of popular product AndroGel. Including the case Mitchell V. AbbVie in the US District Court, Northern District of Illinois, where handed a $150 million in damages[1].

Plaintiff’s Claims:

  • Misled consumers to believe that AndroGel is a safe treatment to counteract the decline in hormone levels caused by injury or disease; notwithstanding causing a number of dangerous side effects.
  • Disease Mongering, a practice of “widening the diagnostic boundaries of illnesses and aggressively promoting their public awareness in order to expand the markets for treatment[2]” in order to increase their sales.
  • The use of aggressive direct-to-consumer and physician marketing to persuade men to inquire about testosterone therapy with physicians.

Testosterone therapy, like the use of AbbVie’s AndroGel, is associated with a number of severe adverse side effects. Testosterone side effects include:

  • Heart Attack
  • Blood Clots
  • Strokes and Mini-Strokes

The FDA’s Adverse Events Reporting System (FAERS) lists over 15,000 adverse events associated with AbbVie’s Androgel. Of the 15,690 adverse events, over 8,000 are labeled as serious, including 700 death, as of August 31, 2017.

FAERS Reports include:

  • 1,208 heart attacks (myocardial infractions) including 116 deaths
  • 1,901 thromboses (blood clots and DVT) including 80 deaths
  • 836 hospitalizations

In March of 2015, the U.S. Food and Drug Administration required labeling changes to prescription testosterone products, to reflect the possible increase risk of heart attack and stroke associated with testosterone use. Thousands of federal lawsuits have been filed against testosterone therapy product manufacturers because of this increased risk. Many of the lawsuits are against name brand products like Testim, Axiron, Fortesta, Striant, Depo-Testosterone and AndroGel.
