Workers’ Compensation Claims

Being injured on the job can lead to various different hardships and difficulties that can prove to be immensely stressful and very time consuming. If you or a loved one has been injured on the job, you may be eligible for cash benefits and/or medical care, known as Workers’ Compensation. This is a type of insurance that is paid by employers (and not paid into by employees) to cover any sort of eligible on the job accident. If you’ve been injured on the job and think that you may be eligible to receive workers’ compensation benefits, call Martin, Harding & Mazzotti, LLP at our White Plains, NY office for a free consultation.

Workers’ Compensation claims are unique in that they don’t place fault on one single party. This means that payouts are independent of carelessness or fault, however, some instances will disqualify a worker from their ability to file a Workers’ Compensation claim:

1. If the injury had resulted solely from an individual being intoxicated from drugs or alcohol
2. If the injured worker had the intention of injuring themselves or others
3. If the injury resulted when an employee’s conduct violated company policy or committed a serious crime

Disputes are handled by a Workers’ Compensation law judge, who decides which party is correct. Upon the determination that an illness or injury in question was work-related, a claim is paid by the employer’s insurance company and the sick or injured employee will then receive the cash benefits or medical care that they are entitled to. It is important to note that employees are only eligible for Workers’ Compensation after a decision is made: only disability benefits can be paid before this decision is finalized. If these disability benefits are paid during the decision period, however, they will be deducted from the final Workers’ Compensation payment. If you are seeking compensation from your employer for a work-related injury or illness, do not hesitate to call our experienced team of Workers’ Compensation lawyers at Martin, Harding & Mazzotti, LLP today.

Workers’ Compensation and the claim process behind it is a complicated system that varies from state to state, but our experienced attorneys are well versed in Workers’ Compensation law and will ensure it is handled properly and efficiently. Railroad / FELA Claims

FELA Claim Attorneys

Long before compensation laws came into existence in our country, Congress worked to protect the rights of injured railroad workers through the Federal Employer’s Liability Act (FELA). This statute was designed to benefit and protect railroad employees who were injured during the course of their employment due to some fault or negligence of the railroad. FELA required that railroad employers provided their employees with a safe place to work.

Damages recoverable through a FELA claim can include:
• Past and future medical expenses
• Past and future lost wages
• Physical pain and suffering
• Mental and emotional suffering
• Loss of earning capacity
• Permanent partial or full disability

FELA covers four types of injuries that workers may experience:
• Traumatic injuries, such as joint sprains, broken bones, and pulled muscles
• Repetitive motion injuries, such as carpal tunnel or tendonitis
• Occupational diseases such as asbestosis, hearing loss, lung cancer, etc.
• Aggravations of pre-existing conditions

To prevail in a FELA claim the railway worker must show not only that the railroad was negligent, but also that the railroad’s negligence played some role causing the injury. In other words, the employee must prove that the railroad did not provide the employee with a safe place to work. It is important to remember that FELA is not like a traditional worker’s compensation case – There is no guarantee that you will receive benefits because you were injured on the job.

Let our White Plains legal team of FELA claim attorneys assist you in filling out your claim and seek the full benefits in which you are entitled to.
