Commonly Asked Slip and Fall Questions

Hi, my name’s Dan Dagostino. I’m a Managing Attorney here at Martin, Harding & Mazzotti. And, with winter coming, one of the most common questions we get asked is, “If I fall and get injured on somebody else’s property, what are my rights and what are my responsibilities?” And when we do get those calls in here, the first question we ask is, “Where did you fall?”

And, although there’s subtle differences with regards to whether it’s municipal property as opposed to private property, the general premise is, people must maintain their property in a reasonably safe manner so that people don’t sustain injuries if they do come upon that property. And when we do go through that analysis, we do ask them, “Did you report the incident?” It’s very important, if you do fall, that you report the incident to the person or place where you had fallen.

Also, if you’re able to take photographs of the defective condition or the area of where you’d fallen, that’s important. It allows us to look at the property as close to exact as when you’d fallen on that property.

And lastly, we tell people, “If you are injured, make sure you get the medical treatment that you need so that your injuries can get better and you can heal as best as you can.”
