I’m attorney Paul Harding with the law firm Martin, Harding and Mazzotti – the Heavy Hitters – here in Plattsburgh, New York.
We’ve been handling personal injury cases since 1994. And the most common type of personal injuries we see are related to car accidents.
Which is no surprise, there are almost 30,000 car accidents per day in the U.S. Many of which result in serious injury or even death. In the one minute it will take to watch this video, three car accidents will have already happened in our country. Victims of these wrecks, victims just like you, need a lawyer they can trust.
If you’ve been injured and would like to discuss your accident with a lawyer you can trust, visit our chat feature here on the website 24/7 or call us now at 1800LAW1010 for a free, no obligation case evaluation.
We’re Martin, Harding and Mazzotti – the Heavy Hitters and we look forward to helping you get the money you deserve.
If you or someone you know has been involved in a car accident, it is likely you understand how complicated and confusing it can be to try and understand the legal steps involved in defending your rights. Don’t stress, the car accident lawyers at Martin, Harding & Mazzotti, LLP® understand the procedures necessary to ensuring that your rights are protected during the legal process, and can answer any questions you may have before or during the process. Car accidents not only affect those directly involved, but often the families and loved ones that the injured may be providing for. Our Plattsburgh legal team of auto accident attorneys is committed to providing you the aggressive representation we believe you are rightfully deserved in your pursuit of legal action.
New York State’s No Fault Law declares that regardless of who’s at fault for the accident, any injured person is automatically entitled to recover for lost wages, medical expenses, as well as other incidentals from the company insuring the vehicle that one was riding in at the time of the accident. This law also applies to pedestrians struck by a moving vehicle; that vehicle is also responsible for paying those same benefits as if the person was injured inside the car being driven. However, in order to properly preserve the rights of the injured, there are important time tables that need to be followed closely.
If you have been involved in an auto accident and believe you are entitled to recover for pain and suffering, No-Fault insurance does not provide compensation unless a “serious injury” can be proven. A few examples of injuries that qualify as “serious” include:
- Significant disfigurement (Such as a scar however, the injury must be significant enough to cause a reasonable person to view the result as “unattractive, objectionable, or as the subject of pity or scorn”)
- Loss of a fetus
- Significant limitation of use of a body, function, or system
- Permanent consequential limitation of use of a body, organ, or member
- Permanent loss of use of a body, organ, member, function, or system
- An impairment/injury of a non-permanent nature that prevents the victim from conducting his or her usual and customary daily activities for a period of at least 90 days during the 180 days immediately following the accident
Our expert automobile accident attorney’s previously gained knowledge and expertise will be used to assess the medical care and treatments that one receives in order to better advise and assess whether one’s injuries qualify as “serious” under NY State Insurance Law.
Have you been the victim of a hit and run or have you been hit by an uninsured driver? NYS law also states that one is able to make a claim with their own personal car insurance if either of these horrible incidents occurred. Furthermore, if you were an occupant to a vehicle or a pedestrian, and injured in an accident, you may be entitled to additional insurance coverage provided by any policy applicable to a vehicle you own, or even a vehicle owned by a relative in your household.
When it comes to protecting your rights, you deserve the best and brightest team behind you. Perhaps the most important but most costly step in the legal process is figuring out which insurance coverage best covers you and maximizes your recovery. Don’t hesitate to call the expert car accident lawyers at Martin, Harding & Mazzotti, LLP® to help research those complex insurance coverage aspects of your case.
