Workers’ Compensation Claims

If you or a loved one has been injured on the job, be sure that you are aware of the New York State Workers’ Compensation laws. The purpose of Workers’ Compensation law is to provide medical care and/or cash benefits for employees who have been injured or have fallen ill, as a result of their job, while accommodating both employee and employer interests. For example, employees are not required to pay any part of the cost of the insurance or compensation, and are eligible to receive payments if their ailment was work-related. On the other side, employees cannot sue their employers for negligence or unsafe working conditions after being injured.

Contact the experienced Workers’ Compensation lawyers at Martin, Harding & Mazzotti, LLP® in Plattsburgh, NY to see how we can help protect your rights and get you the money you rightfully deserve.

Under current Workers’ Compensation laws, no party is at fault, meaning an injured employee cannot receive any less or more money despite their carelessness or the employers’ negligence. A few circumstances that negate an employee’s right to a Workers’ Compensation claim are as follows:

  • If the injury had resulted from the employee being intoxicated (either drugs or alcohol)
  • If the injured party had the intention of injuring themselves or others
  • Injury resulted when an employee’s conduct violated company policy or committed a serious crime

If a dispute should occur about whether or not the injury was work-related, the case is brought before a Workers’ Compensation law judge. During this time, no benefits can be provided to the injured; only upon a decision in their favor will they receive Workers’ Compensation benefits. During the time at which the case is in dispute, one may be eligible to receive disability benefits. However, if disability benefits were collected, that amount must be deducted from the total amount of which they were awarded through Workers’ Compensation.

Workers’ Compensation laws can be confusing and leave injured employees and their families in a financial struggle. Contact the Workers’ Compensation lawyers at Martin, Harding & Mazzotti, LLP® today to see what we can do for you.

Have you been injured or fallen ill and believe that it is work related? Is your employer not responding or refusing to file a claim? Work-related injuries

Are you suffering from a work related injury? This may come as a surprise to some, but Workers’ Compensation benefits often include coverage of medical expenses, lost wages due to missed work, as well as an award for the injury endured if you have been injured on the job. Even if your injury wasn’t technically sustained “on the job,” you could still have a case if it’s the result of long-term effects from your employment.

In order to file a proper claim, one must follow several procedures, such as filing it correctly, representation in court, making sure that you are aware of and collecting all of the available Workers’ Compensation benefits, etc. Martin, Harding & Mazzotti, LLP® in Plattsburgh, NY is committed to providing the best legal representation if you or a loved one has sustained work related injuries.

Railroad / FELA Claims

FELA Claim Attorneys

The Federal Employers’ Liability Act1(FELA) was passed by Congress in 1908 in an effort to better protect the rights and health of railroad workers across the US. Under FELA, a railroad worker can seek compensation for injuries suffered if the injured employee can prove negligence on behalf of his employer.

One who seeks to recover damages under the Federal Employers’ Liability Act (FELA) must first establish these four elements:

  • The railroad is a common carrier engaged in interstate commerce (the main function of the company is to offer the public the ability to carry passengers or property from place to place for compensation)
  • He/she was employed by the railroad and assigned to perform duties which furthered the railroad’s interest
  • Demonstrate that harm was sustained while he/she was employed by the common carrier
  • Prove that the harm experienced was a result of the railroad’s negligence – a legal term for failure to take a reasonable amount of care

Once an employee proves the company is liable, he/she is then entitled to compensation for a full range of related damages:

  • Past and future lost wages
  • Past and future medical expenses not covered by employer-provided insurance
  • Loss of earnings capacity
  • Physical pain and suffering
  • Mental and emotional suffering
  • Disfigurement or scarring
  • Partial or permanent disabilities

Compensation received by injured railroad workers is often higher than the average compensation provided to other industries’ workers who file claims through State Workers’ Compensation.

Decisions made by the railroad company, as often as day-to-day functioning can be considered careless, and acknowledged as “negligent”” by law. Such decisions include, but are not limited to:

  • Failure to provide proper safety equipment
  • Failure to prevent chronic repetitive stress injuries
  • Exposure to toxic chemicals and other dangerous substances
  • Poor maintenance of trains, rails or other equipment
  • Bad decisions or inattention by other railroad employees

Do you believe that you or a loved one has been wrongfully injured and the railroad company could have prevented it? Don’t wait. Call the leading FELA claim lawyers of Martin, Harding & Mazzotti, LLP® , The Heavy Hitters® to get your free case consultation today. Our experienced Plattsburgh, NY legal team is highly trained in FELA claim litigation and is here to get you the money you deserve. Call your FELA attorneys at (518) 561-1010.
