Automobile Accident Injury Lawyers

If you have been injured in an auto accident, do not hesitate to reach out for assistance. It is important to know the rights you are entitled to, regardless of who is at fault for the accident. Our Syracuse automobile accident lawyers are available 24/7 to answer any questions you may have about your accident. Your rights are important and we want to help you protect them.

If you have been injured, you may be eligible to collect on lost wages, medical expenses, and damages or losses covered by the insurance company of the car involved in the accident. Again, you do not have to be at fault in order to be compensated for your injury. This is also true if you were a pedestrian struck by an automobile. In this case you are entitled to compensation and benefits from the insurance company of the driver that hit you, and potentially from your insurance company as well.

No-Fault insurance protects those who have been injured in an auto accident, however it does not compensate for pain and suffering. In New York, in order to claim for pain and suffering, you must have sustained a “serious injury” as defined by Insurance law. The following injuries are included in the “serious injury” requirement:

    • Death
    • Dismemberment
    • Significant disfigurement (Such as a scar. However, the injury must be significant enough to cause a reasonable person to view the result as “unattractive, objectionable, or as the subject of pity or scorn”)
    • Fracture
    • Loss of a fetus
    • Significant limitation of use of a body, function or system
    • Permanent consequential limitation of use of a body, organ or member
    • Permanent loss of use of a body, organ, member, function or system; and
    • An impairment/injury of a non-permanent nature that prevents the victim from conducting his or her usual and customary daily activities for a period of at least 90 days during the 180 days immediately following the accident.

If you have been involved in a hit and run accident, or if the driver that hit you is uninsured or under-insured, you could be eligible to make a claim against your own insurance company. However, in order to do this, you must follow strict guidelines to ensure your eligibility. We are pleased to say we offer free consultations on this process. If you think you are eligible, contact the Martin, Harding & Mazzotti, LLP Syracuse, New York office today.

Perhaps the most important, and costly step of the legal process is figuring out which insurance coverage is best for your situation. Do not hesitate to call our team of car accident lawyers at Martin, Harding & Mazzotti, LLP ® to help decide how to best proceed with your case.

Motorcycle Accidents

Motorcycle Accident Lawyers

Far too many accidents involving motorcycles are caused by other drivers, not the motorcycle rider. Surprisingly, motorcyclists’ rights are not protected under No-Fault Insurance, even though injuries sustained by motorists are usually more severe than those of automobile drivers. This means you run the risk of being held liable for large medical bills and could be rejected for compensation of missed work if you do not have adequate legal representation.

A part of the NYS law that favors victims of motorcycle accidents is that injuries do not have to be considered a “serious injury” to claim compensation, like those involved in car accidents need to. The difference is you can collect on your injuries no matter how minor, unlike in a car accident where injuries must be severe to collect compensation. Essentially, motorists are treated as hit & run victims would be, or as someone who was hit by an under-insured, or non-insured driver.

The law regarding motorcycle accidents requires you to jump through a number of legal hoops to protect your rights. Our Syracuse motorcycle accident attorneys are experienced and will help preserve your rights. Call us today for a free consultation at (315) 529-1010 or reach us toll-free at 1800LAW1010® (1-800-529-1010).

Commercial Truck Accidents

Sleep deprivation can kill

Commercial truck accidents can be both physically and mentally scarring. If you or a loved one has been involved in an accident with a semi-truck and have sustained injuries as a result, we are here to help you. Don’t wait, please contact the semi-truck accident attorneys of Martin, Harding & Mazzotti, LLP® for a free case consultation.

Each year, over 3,500 people are killed in accidents involving large trucks. What may be shocking to you is in truck vs. passenger car accidents, 97 percent of deaths were the drivers or passengers of the car. There are strict laws and regulations in place that the trucking industry must abide by in order to legally be on the roads. Everyday trucking procedures are enforced by both state and federal governments, which control:

  • Driver and licensing qualifications
  • Hours of service
  • Maintenance and inspection procedures

Due to the size and weight of these trucks, injuries inflicted by a truck accident are typically more severe than a crash between two cars. Possible injuries you may suffer from after an accident with a semi are:

  • Broken bones & sprained joints
  • Vehophobia (fear of driving)
  • Temporary or permanent disability
  • Traumatic brain injury (TBI)
  • Lost limbs
  • Other catastrophic injuries
