Have you or someone you know been injured in an automobile accident? Don’t hesitate to take action in defending your legal rights. At Martin, Harding & Mazzotti, LLP®, our Albany team of car accident lawyers is available to answer any questions concerning your accident, and we ensure aggressive representation for all of our clients involved in an auto accident.
If you have been injured in an automobile accident, it is important to know that despite who is at fault for the accident, you are automatically entitled to recover compensation.
No-Fault insurance coverage requires that the insurance company that was covering the vehicle you were occupying at the time of the accident will cover medical expenses, lost wages and any additional incidentals the company specifies. The same rules apply if you were a pedestrian at the time an injury was sustained; the above benefits will be paid for by the insurance company covering the driver in the vehicle that caused the injury, as well as the possibility for further coverage either by your own insurance policy or a resident relative of your household.
If you were the victim of a hit and run, or if the driver that struck you has little or no insurance, you are able to make a claim against your own automobile insurance policy. To ensure that you are able to collect all available benefits from No-Fault insurance coverage; you must follow all of the built-in timelines. Contact the Albany personal injury law firm of Martin, Harding & Mazzotti, LLP® for a free consultation today, so that we can help this process be as stress-free as possible.
While the benefits of No-Fault coverage are very helpful if you have been unable to work, or have any medical expenses as a result of the accident, it does not award money for pain and suffering. In New York State, one must experience a “serious injury” in order to collect for pain and suffering. The insurance law defines a “serious injury” as:
- Significant disfigurement (such as a scar; however, the injury must be significant enough to cause a reasonable person to view the result as “unattractive, objectionable, or as the subject of pity or scorn”)
- A fracture
- Loss of a fetus
- Significant limitation of use of a body, function, or system
- Permanent consequential limitation of use of a body, organ, or member
- Permanent loss of use of a body, organ, member, function, or system
- An impairment/injury of a non-permanent nature that prevents the victim from conducting his or her usual and customary daily activities for a period of at least 90 days during the 180 days immediately following the accident
Let’s face it – too often motorcycles on the road go unnoticed simply because of their small size and ability to hide in the blind spots of other drivers. This unnerving fact coupled with the lack of protection around a motorcyclist can lead to devastating injuries for the motorcyclist. If you have been injured while riding, contact our motorcycle accident lawyers for your free consultation today.
Since motorcycle injuries are often very harmful to the occupants, huge medical bills and lost wages may go uncompensated if your legal rights are not fully protected. However, unlike injuries sustained in an automobile accident, New York State law does not require a motorcyclist to prove an injury was “serious” in order to make a claim against the responsible party. Also under this law, motorcyclists are eligible for reimbursement of their medical expenses, lost wages, and pain and suffering caused by the accident.
If you were involved in a hit and run motorcycle accident, or if the driver of the vehicle that struck you was uninsured or under-insured, you can make a claim under your own insurance policy. Furthermore, if you were a pedestrian or an occupant of a motorcycle and sustained an injury from the accident, you may be entitled to make a claim against your own, or a resident relative’s insurance policy.
Commercial Truck Accidents
Have you or a loved one been injured in a tractor trailer accident? Did you know that there are a number of safety laws and regulations that truck drivers must comply with in order to drive these trucks legally?
The laws and regulations mentioned above are set in place by both the federal and state governments to and control a number of everyday safety procedures including, but not limited to:
- Maintenance and inspection procedures
- Hours of service
- Driver and licensing qualifications
When a tractor trailer is involved in an accident, the result is often much more severe than most automotive accidents. The size and weight of trucks increases their ability to cause damage to smaller vehicles and their occupants. Accidents caused by tractor trailers can result in severe, long-term injuries. Don’t let the actions of a truck driver cause your family more pain and suffering than it already has. The experienced Albany truck accident lawyers are here to help you with the legal process while allowing you to focus on recovering.
