If you or a loved one has been injured on the job, be sure that you are aware of the New York State Workers’ Compensation laws. The purpose of Workers’ Compensation law is to provide medical care and/or cash benefits for employees who have been injured or have fallen ill, as a result of their job, while accommodating both employee and employer interests. For example, employees are not required to pay any part of the cost of the insurance or compensation, and are eligible to receive payments if their ailment was work-related. On the other side, employees cannot sue their employers for negligence or unsafe working conditions after being injured.

Under current Workers’ Compensation laws, no party is at fault, meaning an injured employee cannot receive any less or more money despite their carelessness or the employers’ negligence. If a dispute should occur about whether or not the injury was work-related, the case is brought before a Workers’ Compensation law judge. During this time, no benefits can be provided to the injured; only upon a decision in their favor will they receive Workers’ Compensation benefits. During the time at which the case is in dispute, one may be eligible to receive disability benefits. However, if disability benefits were collected, that amount must be deducted from the total amount of which they were awarded through Workers’ Compensation.
